Terms of service

These terms govern your use of Wilpum Investments Ltd (the "platform"), operated by Wilpum Investments Limited. By creating an account or using the platform you agree to them. Please read them alongside our privacy policy.

1. Who we are, and what we do not do

Wilpum Investments Limited operates a marketplace connecting people looking for homes with the people who own or manage them. We are not an estate agent, we do not act for either party, and we are not a party to any tenancy agreement reached through the platform.

We verify that a lister has evidenced the right to let a property before their listing becomes visible. That verification is a check on documents presented to us; it is not a guarantee of the condition of a property, the conduct of a landlord, or the suitability of any tenancy.

2. Your account

• You must be 18 or older to hold an account.
• The information you give us must be accurate, and you must keep it current.
• You are responsible for activity under your account and for keeping your credentials secure.
• One person or entity per account. Team access is granted through seats, not shared passwords.
• We may suspend an account where we reasonably believe these terms have been breached.

3. Listing a property

If you list a property you confirm that you own it or are authorised to let it, that the details and photographs are accurate and current, and that every charge a tenant would pay is disclosed on the listing. Listings that are inaccurate, duplicated, or no longer available may be removed without notice.

4. Fees and subscriptions

Searching, saving, messaging and booking viewings are free for people looking for a home. Listing is charged by subscription at the rates published on our pricing page. We take no commission on rent or deposits. Subscriptions renew automatically until cancelled; cancelling stops the next renewal and leaves your listings live until the end of the paid period.

5. Acceptable use

• Do not post false, misleading or discriminatory content.
• Do not use the platform to advertise a property you have no right to let.
• Do not scrape, resell or bulk-extract listing or user data.
• Do not attempt to move a transaction off-platform to avoid fees or accountability.
• Do not harass, threaten or impersonate anyone.

6. Reviews

Only users who have viewed or rented a property through the platform may review it. Reviews must be a genuine account of your own experience. We remove reviews that are fabricated, defamatory, or written in exchange for payment, and landlords may publish a reply.

7. Liability

We provide the platform with reasonable skill and care, but we do not warrant that it will be uninterrupted or error-free. To the extent permitted by law, we are not liable for any tenancy, transaction, dispute or loss arising between users. Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud.

8. Changes

We may update these terms. Where a change is material we will give notice through the platform or by email before it takes effect. Continuing to use the platform after that constitutes acceptance.

9. Governing law

These terms are governed by the laws of Kenya, and the courts of Kenya have exclusive jurisdiction.
